IHC will hear tax reference filed by M/s Mobizone against FBR

ISLAMABAD: The Islamabad High Court (IHC) will hear a tax reference on Monday filed by M/s Mobizone Pakistan (Private) Limited against the Federal Board of Revenue (FBR).

A single bench of the IHC comprising Justice Aamer Farooq would hear the case seeking restrictions for the Large Taxpayers Unit, Islamabad, from recovering outstanding tax of Rs 458,132,655.

The appellant had challenged an LTU order, dated February 8, 2016 before the IHC after exhausting the departmental platform for appealing disputing orders.

According to the order issued by the LTU, the appellant had been asked to pay Rs436,317,052 under the head of federal excise duty along with penalty of Rs21,815,603 under section 19 of Federal Excise Act, 2005. The appellant had to pay sum of Rs458,132,655 as tax liability under the impugned order.

Federal Board of Revenue (FBR), Appellate Tribunal Inland Revenue (ATIR), LTU Commissioner Inland Revenue and Assistant Commissioner Inland Revenue were made respondent in the case.

The appellant had prayed the court to directed LTU not to recover the said amount and abstain from any coercive action in this regard.

The appellant submitted before the court that the impugned order was issued under mala fide intentions and had no legal standing or authority and the court may decide on relief which it deemed appropriate in this regard.
