M/S KB Steel’s plea against anti-dumping duty on rolled sheets adjourned

KARACHI: The Sindh High Court (SHC) on Monday adjourned the hearing of petition filed by M/S KB Steel Industries Private Limited against imposition of provisional anti-dumping duty on consignment of “cold rolled sheets”

A two-member bench, headed by Chief Justice Sajjad Ali Shah heard the petition.

Earlier petitioner’s counsel stated that petitioner was engaged in imports of cold rolled steel sheets in coils and seriously aggrieved with the imposition of provisional anti-dumping duty by the National Tariff Commission secretary vide its notice ADC No 35/2015/ NTC/CRC dated 13/01/2016 and enforcement for collection by the Customs Appraisement-West collector on the consignments.

Counsel argued that, it was not otherwise payable under the law as the petitioner has entered into import contract and established letter of credit prior to the publication of impugned notice dated January 13, 2016 for imposition of the impugned duty. The counsel said that at the material time of opening the letter of credits, neither any anti-dumping duty had been imposed on the imported goods nor petitioner was aware of any pending investigations for the purpose of imposition of anti-dumping duty under the Anti-Dumping Duty Act, 2015.

Citing Revenue Division secretary, National Tariff Commission secretary/chairman and others as respondents, petitioner pleaded the SHC may declare that provisional anti-dumping duty on said goods through notice dated 13 Jan 2016 cannot be levied, imposed and enforced retrospectively.
