SHC seeks remarks from tax authorities on plea filed by Asad Zaheer

KARACHI: The Sindh High Court (SHC) on Thursday told secretary Revenue Division, Commissioner -IR, Zone – IV LTU -II Income Tax and others, directing them to file their respective comments on an application filed by Asad Zaheer against suspension of his sales tax registration.

A two-judge bench, headed by Justice Munib Akhter, was hearing the application. During the hearing, the counsel for the respondents requested some time for filing para wise comments.

Earlier, the petitioner’s counsel stated that the petitioner was manufacturer of plastic products made of the raw material imported by him. The respondents issued a notice on March 16, 2016 for physical stock verification on the basis of the allegation that the amounts of stock appeared to have been missing from the petitioner’s monthly sales tax returns.

According to the petitioner, after the physical verification, the respondents had suspended his sales tax registration on the basis of that the petitioner’s business concern did not exist at the declared address and for the alleged purpose of preventing the probable revenue loss to the national exchequer.

The counsel for the petitioner pleaded the court to declare the said act of the respondents as illegal, malafide and unjustified. The court was further requested to restore the sales tax registration of the petitioner.
